These Terms of Service govern your access to and use of the services provided by Adventure Life, including travel planning, itinerary development, destination guidance, online consultation, and all related informational resources. By engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety.
Acceptance of Terms
By accessing our website, submitting a consultation request, or engaging Adventure Life for any travel-related service, you affirm that you are at least 18 years of age, possess the legal authority to enter into binding agreements, and agree to comply fully with these Terms of Service. If you are accessing our services on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.
Adventure Life reserves the right to modify these Terms of Service at any time and without prior individual notice. Changes become effective upon posting to our website. Continued use of our services following such modifications constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically to remain informed of any updates.
If you do not agree with any part of these terms, you must immediately discontinue use of our website and refrain from engaging our services. Your use of Adventure Life services is also subject to our Privacy Policy and Refund Policy, each of which is incorporated herein by reference.
Description of Services
Adventure Life provides professional travel planning and advisory services to individual travelers, couples, families, and groups. Our core service offerings include, but are not limited to, the following:
- Travel Planning Services: Comprehensive trip planning assistance tailored to your timeline, preferences, and budget constraints. This includes research, logistics coordination, and vendor recommendations.
- Itinerary Development: Custom day-by-day travel programs that outline activities, accommodations, transportation, and timing for your chosen destination(s).
- Destination Guidance: Detailed advisory reports covering climate, cultural expectations, safety considerations, visa requirements, and local customs for specific countries or regions.
- Online Travel Consultation: One-on-one or group video and messaging sessions with experienced travel specialists to address questions, concerns, and planning challenges in real time.
- Travel Information Resources: Access to curated guides, articles, destination profiles, and checklists that help travelers prepare thoroughly for any type of journey.
Adventure Life acts solely as a travel advisory and planning service. We do not operate as a licensed travel agency or tour operator in the traditional sense and do not directly book transportation, accommodation, or excursions on behalf of clients unless expressly agreed in writing. All bookings made through third-party vendors remain subject to those vendors' own terms and conditions.
Please note that service availability, pricing, and scope may change without notice. Adventure Life reserves the right to discontinue, modify, or suspend any service at any time. Clients will be notified of significant changes via the email address on file.
Client Responsibilities
To receive the highest quality of service and ensure a smooth planning process, clients are expected to fulfill the following responsibilities throughout their engagement with Adventure Life:
- Provide accurate, complete, and truthful information about travel preferences, budget, travel history, health considerations, dietary restrictions, and any special needs that may affect itinerary planning.
- Communicate promptly and responsively when Adventure Life specialists request additional information, approvals, or clarifications.
- Review all itineraries, guidance documents, and consultation summaries carefully and notify Adventure Life of any errors, omissions, or concerns within a reasonable timeframe.
- Independently verify visa requirements, vaccination mandates, entry restrictions, and other documentation requirements for all destination countries, as these are subject to change and are ultimately the client's responsibility.
- Obtain and maintain adequate travel insurance coverage for the duration of all planned travel. Adventure Life strongly recommends comprehensive travel insurance covering cancellation, medical emergencies, evacuation, and lost baggage.
- Comply with all applicable laws, regulations, and customs requirements of both the United States and any foreign country visited during travel.
- Treat Adventure Life staff and consultants with respect. Any abusive, threatening, or harassing communications will result in immediate termination of services without refund.
Failure to fulfill these responsibilities may result in service interruption, delays, or outcomes that Adventure Life cannot be held responsible for. Any additional costs incurred due to client-provided inaccurate information will be the sole responsibility of the client.
Payment Terms & Pricing
All services rendered by Adventure Life are subject to the pricing schedules displayed on our website at the time of purchase or agreement. Prices are denominated in US Dollars (USD) and are subject to applicable taxes and fees as required by law.
Payment for services is required prior to the commencement of work unless an alternative payment arrangement has been explicitly agreed upon in writing by an authorized representative of Adventure Life. Accepted payment methods include all major credit cards, debit cards, and any other methods displayed at checkout.
- Consultation sessions must be paid in full at the time of booking. Sessions not cancelled within 24 hours of the scheduled time are non-refundable.
- Itinerary development services require a deposit of 50% upon project initiation, with the remaining balance due upon delivery of the completed itinerary document.
- Destination guidance reports and travel information resources are charged at the rates listed at the time of purchase and are payable in full before delivery.
- Full travel planning packages are subject to individually negotiated payment schedules, to be outlined in a written service agreement prior to commencement.
Adventure Life reserves the right to adjust pricing at any time. Any such adjustments will not affect services already paid for but will apply to future engagements. Clients with ongoing service agreements will be notified of pricing changes with at least 14 days' advance notice.
All transactions are processed through secure, encrypted payment gateways. Adventure Life does not store payment card information on its servers. For billing disputes or questions, please contact us at plan@adventure-life.org within 30 days of the transaction date.
Limitation of Liability
Adventure Life provides travel planning and advisory services based on the best available information and professional expertise at the time services are rendered. However, travel inherently involves uncertainty, and circumstances beyond our control — including but not limited to natural disasters, political instability, civil unrest, public health emergencies, airline cancellations, and changes in government regulations — may affect your travel experience.
To the fullest extent permitted by applicable law, Adventure Life, its officers, directors, employees, consultants, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- The cancellation, delay, or interruption of travel plans due to force majeure events or circumstances beyond Adventure Life's reasonable control.
- The acts or omissions of third-party vendors, including airlines, hotels, ground transportation providers, and tour operators recommended or utilized during your trip.
- Injury, illness, loss, or damage sustained by the client or members of their travel party during the course of their journey.
- Inaccuracies in travel information provided by government bodies, tourist boards, or other external sources that Adventure Life relied upon in good faith.
- Client failure to obtain appropriate travel insurance, required visas, health documentation, or other mandatory travel credentials.
- Any decisions made by the client that deviate from the recommendations and itineraries provided by Adventure Life.
In no event shall Adventure Life's total cumulative liability to a client exceed the total fees paid by that client for the specific services giving rise to the claim in the twelve (12) months preceding the incident. This limitation applies regardless of the legal theory under which the claim is brought.
Intellectual Property
All content, materials, and deliverables created by Adventure Life — including itineraries, destination guides, consultation summaries, written reports, travel frameworks, website content, graphics, and branding elements — are the exclusive intellectual property of Adventure Life and are protected by applicable copyright, trademark, and trade secret laws of the United States and international conventions.
Upon full payment for services, clients receive a limited, non-exclusive, non-transferable license to use the materials created for them solely for personal travel planning purposes. This license does not permit:
- Reproduction, redistribution, or resale of any Adventure Life materials for commercial purposes.
- Publication of proprietary materials on third-party websites, blogs, or social platforms without prior written consent from Adventure Life.
- Modification, adaptation, or creation of derivative works based on Adventure Life deliverables.
- Attribution of Adventure Life's work to any individual or entity other than Adventure Life.
Adventure Life respects the intellectual property rights of others. If you believe any content on our website infringes upon your intellectual property, please contact us promptly at plan@adventure-life.org with relevant details so we may investigate and take appropriate action.
Privacy & Data Collection
Adventure Life is committed to protecting the privacy and personal data of all clients. The collection, storage, processing, and use of your personal information is governed in detail by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the data practices described in our Privacy Policy.
We collect only the information necessary to deliver high-quality travel planning services, including name, contact details, travel preferences, and payment information. This data is never sold to third parties and is handled in accordance with applicable United States privacy laws and industry best practices.
Governing Law & Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles. Any dispute arising from or relating to these terms or the services provided by Adventure Life shall first be subject to good-faith negotiation between the parties.
If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration conducted in Colorado Springs, Colorado, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding on both parties. Each party shall bear its own legal costs and fees, except where the arbitrator determines otherwise.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where such relief is necessary to prevent irreparable harm.
Termination of Services
Either party may terminate the service relationship with Adventure Life at any time. Clients who wish to discontinue services should provide written notice to plan@adventure-life.org. Refunds for terminated services are subject to the terms outlined in our Refund Policy.
Adventure Life reserves the right to terminate or suspend services, with or without notice, in cases of:
- Violation of any provision of these Terms of Service or our other policies.
- Non-payment or fraudulent payment attempts.
- Abusive, threatening, or harassing behavior toward Adventure Life staff.
- Discovery of materially false or misleading information provided by the client.
- Any activity that Adventure Life reasonably believes poses a legal, reputational, or operational risk.
Upon termination, any outstanding balance for work completed to date shall remain payable. Provisions of these Terms relating to intellectual property, limitation of liability, and dispute resolution shall survive termination.
Miscellaneous Provisions
If any provision of these Terms of Service is found to be invalid, unenforceable, or contrary to applicable law, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The failure of Adventure Life to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Adventure Life with respect to the subject matter hereof and supersede all prior agreements, understandings, and representations, whether written or oral.
Adventure Life's services are provided from our offices in Colorado Springs, Colorado. We do not guarantee that our website or services are appropriate or available in all jurisdictions. Clients accessing our services from outside the United States do so at their own risk and are responsible for compliance with local laws.
